This privacy policy applies to www.affogata.com and related services available therein.
 

Affogata (“Affogata” or “we”, “us” or “our”)respects the privacy of anyone who uses a Affogata website and platform or the Affogata Service. Affogata publishes this Privacy Policy to communicate how we gather and use information about you and how we protect it. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information.

  1. Customer and User Data

    1. As part of the Services provided to our clients, we may process or store information on behalf of our customers (“Customer Data”). Customer Data may include company name, business contact name and title, phone number, email and other contact details, billing address, financial account, credit card information, order details, subscription and license information. In addition, we may collect user related data such as credentials and profile data (name, contact, authorized users), email addresses, phone number, Country of residence, avatar, pictures and text uploaded to our system etc. (“Personal Data”). We do not collect usage details about customer end users, except as necessary to provide and support the Services requested by customers.

    2. Customer Data is deemed to be owned and controlled by our customers. Such Customer Data may include public information or information exchanged between the you and the customer directly. It may also include event logs, end user information (such as IP address, email address and computer name), and other Personal Data. In any event, we processes the Customer Data pursuant to the instructions from our customers. Please note that Our customers’ privacy and security practices are their own and may differ from those set forth in this Privacy Policy. You should refer to privacy and security policies posted by such customers, if needed.

    3. In order to enjoy the full functionality of our Services or to conduct business with us, you may be prompted to provide certain Personal Data to us: (i) by filling in forms (for example, a “Contact Us” form) on our Sites, at a trade show, or anywhere else we conduct business; (ii) by accessing or using the Services; (iii) by subscribing to newsletters or other communications; or (iv) by corresponding with us by phone, e-mail or otherwise using our contact details.
       

  2. Collection and Use of Data

    1. You directly provide us with such data when you use our websites, products, or services, or interact with us by, for example, contacting us. We may also obtain data from your interaction interact with the website. We may also collect technical information on how the website is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

    2. We may also collect and use non-personally identifiable information (Non-PII). Non-PII is information that cannot be used to identify a particular individual. For example, we will collect statistical data, such as the numbers of visits to its website. We collect this data to understand how users use our websites, products, and services so that we can improve our services and better satisfy your needs. We may collect, use, process, transfer, or disclose non-PII for other purposes at its own discretion. We will endeavor to isolate your Personal Data from non-PII and ensure that the two types of data are used separately. If personal data is combined with non-PII, it will still be treated as personal data during processing.

    3. Affogata also collects available data from internet, third party websites and social media platforms by means of its technology as part of the Services provided. Information so collected is generally indexed which means that Affogata never intentionally collects information which has a private status and is not able to access to profiles or pages online and social networks, if the access has been restricted by the user. This is achieved by automated indexing systems which operate through application programming interfaces (API) that Affogata had secured access to. Please note that information indexed from third party sites and platforms is done while adhering to such sites and platforms privacy requirements and other restrictions, and also comply with its protocols. 

    4. Affogata processes different types of data ranging from (i) its employees data; (ii) contact data relating to customers, suppliers, and business partners; (iii) usage and other data relating to its website and platform; (iv) personal data from users of Affogata services available on its platform (the “Services”).

    5. Data (including Customer Data and Personal Data) collected is stored at subcontractors’ data centers, who commit themselves to the same level of requirement and to the respect of the same rules, in particular under Article 28 of the GDPR. The data can only be stored in European Union country members or countries where legislation is regarded as adequate by the law of the European Union.

    6. All of the data collected (including Personal Data Customer Data) is used to ensure standard functions of the Services, user experience, communication, payment, and invoicing. Specifically, Affogata will process your data following the requirements of applicable laws on an appropriate legal basis, including:

  • Processing your personal data to fulfill the contract when responding to a transaction or service request;

  • Processing your personal data with your consent;

  • Processing based on the legitimate interests of Affogata or a third party when we use your personal data to contact you, conduct marketing or market surveys, improve our products and services, execute and improve our loss prevention and anti-fraud programs, and other purposes. Legitimate interests include enabling us to more effectively manage and operate our business and provide our products and services; protecting the security of our businesses, systems, products, services, and customers; internal management; complying with internal policies and processes; and other legitimate interests described in this policy;

  • Processing your personal data as necessary to comply with and fulfill legal obligations.
     

  1. Data Protection Rights

    1. Affogata offers its website visitors and customers a means to choose how we may use information provided. If, at any time after registering for information or ordering the Service, you change your mind about receiving information from us, send us a request specifying your new choice. Simply send your request to privacy@affogata.com. However, please note that withdrawal does not affect the legitimacy and effectiveness of how we process your personal data based on your consent before the withdrawal is made; nor does it affect any data processing based on another justification other than your consent.

    2. We would like to make sure you are fully aware of all of your data protection rights, as follows: 

  • The right to access – You have the right to request us for copies of your personal data. We may charge you a small fee for this service.

  • The right to rectification – You have the right to request that we correct any information you believe is inaccurate. You also have the right to request us to complete the information you believe is incomplete.

  • The right to erasure – You have the right to request that we erase your personal data, under certain conditions.

  • The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.

  • The right to object to processing – You have the right to object to us processing of your personal data, under certain conditions.

  • The right to data portability – You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
     

  1. Cookies & Similar Technologies 

    1. This website stores cookies on your computer. We use cookies to collect information about how you interact with our website and they allow us to remember you if you return. 

    2. Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze the website.

  2. Transfer and Disclosure of Data

    1. Data collected or received may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

    2. If you are located outside of Israel, Affogata headquarters, and choose to provide information to us, please note that we transfer the data, including Personal Data, to Israel and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

    3. We will take steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

    4. We may disclose your Personal Data in the good faith belief that such action is necessary to comply with a legal obligation, to protect and defend our rights or property, to prevent or investigate possible wrongdoing in connection with the website, to protect the personal safety of users of the Service or the public and to protect against legal liability
       

  3. Security

    1. Affogata commits to implementing appropriate technical and organizational measure to guarantee a suitable level of security for each typology of indexed data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Personal Data. In addition, to ensure that data is not intentionally or unintentionally retained for longer than necessary, Affogata has implemented a system for automatic deletion. The standards we  use to determine the retention period are as follows: the time required to retain personal data to fulfill business purposes, including providing products and services; maintaining corresponding transaction and business records; controlling and improving the performance and quality of the website; handling possible user queries or complaints and locating problems; whether the user agrees to a longer retention period; and whether the laws, contracts, and other equivalencies have special requirements for data retention; etc.

    2. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.     3. Affogata also provides each user in your organization with a unique password that must be entered each time a user logs into the Service. As stated above, Affogata is using a session “cookie” to store user sessions and provide an easy to use experience. Cookies do not include either the username or password of the user, or any other confidential user and session information.
       

  4. Service Providers and Third Parties 

    1. Affogata may employ other companies and people to perform tasks on our behalf and need to share customer information with them to provide the Services. Examples include hosting, billing, fulfilling orders, provisioning, sending emails, providing marketing assistance, processing credit card payments, and providing customer service. These companies are authorized to use your personal information only as necessary to provide these services to us. 

    2. Our website or platform may contain links to other websites, and information practices and/or the content related thereto shall be governed by the privacy notices of such other websites. We accepts no responsibility arising from or regarding such third-party websites. You are advised to review the terms and conditions relating to the use of such sites. 
       

  5. Children's Privacy

    1. This Website does not address anyone under the age of 18 ("Children").

    2. We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.
